Terms of Service — KDPie

These Terms of Service (“Terms”) govern your access to and use of KDPie (the “Service”), operated by Pavel Dziubenko, an individual trader established in Montenegro (“we”, “us”). Contact: [email protected]; our postal address is available on request by email. By creating an account or using the Service you agree to these Terms.
1. What the Service is
KDPie is a research and analytics tool for self-publishing authors and publishers. It aggregates publicly observable marketplace signals and third-party data to produce estimates, scores, and research reports about book-market niches, keywords, and competition.
The Service provides research estimates only. It does not — and cannot — guarantee sales, royalties, income, rankings, or any commercial outcome. All scores, verdicts, sales estimates, and search-volume figures are statistical estimates derived from third-party data and our own models; they may be incomplete, delayed, or wrong. Where our data is insufficient, the Service says so instead of inventing numbers; you should treat every figure as advisory input to your own judgment, not as a promise.
No affiliation. KDPie is not affiliated with, endorsed by, or sponsored by Amazon.com, Inc. or its affiliates. “Amazon”, “Kindle”, and “KDP” are trademarks of Amazon.com, Inc. or its affiliates, used only to describe compatibility and subject matter.
2. Accounts
- You must provide a valid email address and keep your credentials secure. You are responsible for activity under your account.
- You must be at least 18 years old and able to enter a binding contract.
- One person or legal entity may hold one account (workspace) unless we agree otherwise in writing. Creating multiple accounts to obtain repeated trials, free allowances, or to circumvent quotas (“multi-accounting”) is prohibited and may lead to suspension of all related accounts.
3. Plans, quotas, and credits
- The Service is sold as subscription plans with monthly usage quotas (e.g. niche validations, AI actions, autonomous research runs). Current plans, prices, and quota amounts are shown on the pricing page and at checkout.
- Quotas reset each billing period. Unused plan quota does not roll over.
- Optional top-up packs add extra quota on top of your plan’s allowance. Unused top-up quota carries over between billing periods and is kept while you are not on a paid plan (spending it requires a paid plan or the remainder of an already-paid period). Packs are non-refundable except where the law requires it, and a refund or chargeback of a pack removes unused top-up credits up to the size of the refunded purchase (see the Refund Policy).
- Some operations that return no usable result are automatically not charged or automatically refunded to your quota; this is a service courtesy applied by our systems, not an entitlement to unlimited retries.
- We may enforce fair-use and anti-abuse limits (rate limits, per-run caps, queue prioritization) to keep the Service reliable for all customers.
4. Billing (Paddle as Merchant of Record)
Orders are processed by our payments partner Paddle (Paddle.com Market Ltd and/or Paddle Payments Ltd), acting as Merchant of Record. Paddle is the seller on your invoice, handles payment processing and applicable taxes (e.g. EU VAT), and its Buyer Terms apply to the purchase alongside these Terms. We never receive or store your full card details.
- Subscriptions renew automatically until cancelled. You can cancel any time, including while a renewal payment is being retried or the subscription is paused. Cancelling stops the renewal: it does not change what the workspace can do at that moment, and it does not withdraw a charge the payment provider is still attempting. If nothing already limits your access when you cancel, access and your remaining credits continue until the end of the paid period; if access has already been reduced, cancelling does not restore it.
- One subscription is active per workspace at a time. You can change plan from the Billing screen while the subscription is active and no change (such as a cancellation) is already scheduled on it. An upgrade charges the prorated difference for the rest of the current period right away and raises your limits at once — or from the start of the next credit window when the current one is about to close; credits already spent stay spent. A downgrade applies immediately, at no charge and with no refund: you keep the current plan’s capacity until the end of the paid period, and the new price applies from the next billing. Switching from monthly to annual billing — to any plan, a smaller one included — is charged right away as an annual purchase, with the unused part of the current month credited by the payment provider; your monthly credit window then follows the new billing date. Switching from annual to monthly billing, and moving to a smaller plan while on annual billing, are handled by support ([email protected]). The exact amount due is always shown before you confirm.
- A paid trial (where offered) converts automatically into the advertised plan at the end of the trial unless cancelled before conversion.
- If a renewal payment fails, the subscription goes on hold and no new credits are granted until the payment succeeds. Because a renewal is charged at the moment your paid period ends, in the usual case there is nothing left to spend and paid actions stop straight away; if any of a paid period does remain, it stays usable. Your plan itself is not downgraded for a short grace period — currently up to 48 hours from the failed charge — which can end sooner if the payment provider cancels or pauses the subscription. After that the workspace moves to the Free plan (no research credits) until a payment succeeds. Research you have already run stays saved and readable throughout.
How the Service is delivered. The Service is delivered entirely electronically; there is nothing to ship and no physical delivery. Access opens by itself as soon as the payment provider confirms the payment — inside the app at app.kdpie.com, on the workspace the checkout was started from. That normally takes a few seconds and needs nothing from you beyond reopening the Billing screen. If access has not opened within 15 minutes of the charge, write to [email protected] with the date and the amount and we will open it by hand; please do not pay a second time. We do not promise money back for a delayed opening — what we owe you is the access you paid for, and that is what we deliver; the windows in the Refund Policy and your statutory rights are unaffected.
5. Acceptable use
You agree not to:
- resell, sublicense, or systematically redistribute the Service’s data or reports as a competing data product;
- scrape, crawl, or bulk-extract the Service beyond the interfaces and quotas provided;
- reverse engineer the Service or attempt to access other customers’ data;
- use the Service to violate any third-party terms or applicable law;
- interfere with the Service’s operation (probing, overloading, circumventing quotas, caps, or safety limits).
Reports and results you generate may be used freely for your own publishing business, including sharing within your team.
6. Your content and data
- You may enter search phrases, seed topics, notes, and identifiers of books you track. You retain your rights to that input.
- You grant us a licence to process your input to operate the Service (including sending relevant fragments to the third-party data and AI providers that power paid features — see the Privacy Policy).
- Aggregated, de-identified research data (e.g. which niches have been scanned) may be retained and reused to improve the shared research dataset that powers the Service. Your private inputs are not shown to other customers except as anonymous aggregate signals.
7. Availability and changes
- We aim for high availability but the Service is provided “as is” and “as available”. Third-party data sources can be delayed, rate-limited, or unavailable; long-running research jobs are queued and may take time.
- We may change, add, or remove features, and may update prices and quotas for future billing periods with reasonable notice (price changes never apply retroactively to an already-paid period).
8. Disclaimers and liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- WE ARE NOT LIABLE FOR PUBLISHING OR BUSINESS DECISIONS YOU MAKE BASED ON THE SERVICE’S ESTIMATES, NOR FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR LOST PROFITS OR LOST DATA.
- OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
- Nothing in these Terms excludes liability that cannot be excluded under applicable law (including mandatory consumer protections in your country of residence).
9. Suspension and termination
We may suspend or terminate accounts that materially breach these Terms (including abuse, multi-accounting, payment fraud, or unlawful use). You may stop using the Service and cancel your subscription at any time. Sections that by their nature should survive (6–8, 10) survive termination.
10. General
- Governing law: these Terms are governed by the laws of Montenegro, without prejudice to mandatory consumer-protection rules of your country of residence. Disputes are subject to the courts of Montenegro unless mandatory law provides otherwise. Purchases processed by Paddle are additionally subject to Paddle’s Buyer Terms.
- We may update these Terms; material changes will be announced on the site or by email with reasonable notice. Continued use after the effective date constitutes acceptance.
